Greek-Australian chef sues McDonald’s and gets $179,000

K. Metaxoulis saved a boy’s life and aggravated an injury he incurred on a holiday to Greece due to McDonald’s negligence

Greek chef Konstantinos Metaxoulis saved the life of a boy named Dylan, aged 5, screamed for help after getting stuck on play equipment at McDonald’s in Castle Hill at Sydney’s  north-west. After saving the boy, he fell two meters to the ground, badly hurting his wrist and aggravating an earlier injury that occurred during a motorcycle accident in Greece 2004.

He successfully sued McDonald’s for negligence. The first NSW District Court judge found he had not proven his case, however the NSW Court of Appeal awarded him $179,000 in damages.

The Greek-Australian chef was awarded damages for past and future economic loss as well as non-economic loss. The fast food giant was also ordered to pay the cost of the legal proceedings.
