The intervention of both the President of the Supreme Court, Ioanna Klapa and the Prosecutor of the Supreme Criminal Court, Georgia Adilini, was immediate in the case of lawyer Apostolos Lytras, and specifically for the fact that he was released on parole despite the brutal beating of his wife.
In particular, the President and the Prosecutor of the Supreme Court ordered an urgent preliminary disciplinary investigation into the possible responsibilities of judicial and prosecutorial officials, regarding their actions at the pre-trial stage in the case of the lawyer, who is accused of domestic violence.
The intervention of the two senior judges took place as Apostolos Lytras was released, while the act for which he is accused is a felony.
The president and the prosecutor are asking for an investigation into whether there is any disciplinary responsibility against the investigating judge and the prosecutor who decided to release the criminal lawyer with restrictions despite the felony nature of the offence he was charged with and the particular gravity of the act he admittedly committed.
Lytras confessed to beating his wife, said he was mentally ill and was released
It will be recalled that the criminal lawyer was released after his apology for the beating of his wife, a decision that caused wonder and concern whether anyone can proceed to violence and then walk around unmolested, claiming that he has a psychological issue and needs help. In his first statement after the decision of the investigating judge and the prosecutor, he admitted that he had beaten his wife and claimed that “I cannot give an explanation” for the incident, adding that he would seek help to cure himself.
Apostolos Lytras was reportedly given a restraining order not to approach his wife. In detail, the conditions imposed on Lytra are the obligation to move from the common house where he lives with his wife, a prohibition to approach her and an obligation to attend a special psychological support program.
“I confessed my act, apologised to my wife who I love more than her and my three daughters. Unfortunately she was in a situation where this incident happened. And I still cannot give an explanation. As she testified I have never been violent. I will look to see how I can heal, seek help,” Apostle Lytras said initially in his statement.
Apostolos Lytras’ statements
Continuing, the criminal lawyer said that “the act that happened is something that for me is unthinkable. I will seek psychological help, I cannot forgive myself for it. No one should be in this situation. You can see how sharp I am even for myself.”
“I apologize to the whole world, to Sophia and our koreas and from there on I want to believe that this matter will be overcome with proper help,” Apostolos Lytras concluded his statement.
The reasoning behind the decision
According to reports, in the decision of the interrogator and prosecutor to release the lawyer on the above conditions “counted” the victim’s testimony that the savage beating was the first time and never had something similar happened before.
The statement of his ex-wife in the interrogation room also counted in favour of the criminal lawyer. It should be noted that this woman had previously denounced the lawyer, but when the trial took place she withdrew her complaint.
The well-known criminal lawyer had been prosecuted on a felony charge of grievous intentional harm to his wife, an offence which according to the Florides Criminal Code is punishable by 5 to 20 years’ imprisonment.
