Ilias Kasidiaris requested his release under conditions in a new application submitted to the Lamia Misdemeanor Court Council. Kasidiaris who was sentenced to 13 years in prison in the case of the Golden Dawn. In his new application, he claims that he has served his entire sentence and is entitled to conditional release.
However, regarding Kasidiaris’ new application, a prosecutorial recommendation has already been submitted, rejecting his request for conditional release.
In response to this prosecutorial recommendation, Ilias Kasidiaris has appealed to the European Court of Human Rights. He argues that the rejection violates the presumption of innocence, as the reasoning cites the fact that his trial in the Golden Dawn case is still pending at the appellate level.
In statements following the suspension of the “Spartans” case, Kasidiaris’ lawyer, Vasso Pantazi, revealed that Ilias Kasidiaris is expecting a decision from the judicial council in the coming days. “We have a person convicted in the first instance who has completed his sentence 9 months ago and has not been released. We are awaiting the council’s decision, but an appeal has also been made to the European Court because they do not accept the presumption of innocence,” the lawyer stated.
