According to recent data from the AADE, of the 3,946,439 taxpayers with overdue debts, 2,206,046 are under seizure of income, deposits, and assets. Already, 1,550,838 of them have been subjected to such measures, while for the remaining 655,208, proceedings will begin in the coming years if they do not pay or settle their debts.
What the legislation provides for
The current legislation allows for enforcement measures for overdue debts of more than €500 that have not been included in a settlement programme.
The measures include:
- – Seizure of chattels in the hands of the debtor or third parties.
- – Seizure of real estate.
Before taking these measures, the tax administration must issue an individual notice of payment of a debt, except in cases of seizure of monetary claims.
After notification of seizure, the debtor is deprived of the right to freely dispose of the property. If not included in a settlement program, the auction date is set within 4 months of the foreclosure and executed within 5 months of the issuance of the program.
If the auction is postponed, a new program is issued within one year. The procedure may be suspended if the debtor is placed in a scheme or a court order of suspension is issued.
