The two doctors from the clinic in Kolonaki, who were remanded in custody over the death of Giorgos Mazonakis, were transferred to Korydallos Prison shortly before 7am.
They were transferred separately, with Ioanna Gaka first being taken from Kypseli Police Station, followed by the transfer of her husband, Ilias Theodoropoulos, who had been temporarily held at the Attica General Police Directorate (GADA).
The decision to remand them in custody was taken following their statements to the authorities, with the agreement of the investigating magistrate and prosecutor, as it was deemed that they should remain in custody pending the further course of the judicial proceedings.
They will be held in specially designated areas
For security reasons, and in order to ensure the smooth operation of the prison as well as their own protection, the two defendants will be held in specially designated areas of Korydallos Prison.
According to information from the General Secretariat for Anti-Criminal Policy, as reported by the Athens-Macedonian News Agency (ANA-MPA), Ioanna Gaka will remain alone in a cell in the prison’s women’s wing, while Ilias Theodoropoulos will be held in a corresponding area in the men’s prison.
These are isolated areas where access by other inmates is restricted, in order to prevent security problems and ensure the protection of the two remanded defendants.
The detention warrants were issued on Wednesday afternoon, with the two defendants facing charges of the felony of intentional homicide with conditional intent, committed by omission, following the upgrading of the original charge from fatal exposure.
They will challenge the detention warrant
It is noted, however, that according to a statement by the lawyers representing the two doctors, they are expected to challenge their detention warrant, arguing that “the procedural rights of their clients have been brutally violated”.
The statement in full:
“The law firm ‘Nikos Agapinos and Associates’, following the expected development regarding the procedural treatment of its clients, Ilias Theodoropoulos and Ioanna Gaka, as a result of the entirely unjustified upgrading of the charge, announces that it will immediately challenge the detention warrant before the competent Council, as it considers that the procedural rights of its clients have been brutally violated.”
