Harvey Weinstein’s third trial in New York ended in a mistrial after jurors failed to reach a unanimous verdict on the charge that he raped actress Jessica Mann.
The 74-year-old Weinstein was once one of Hollywood’s top film and television producers until accusations of raping women led to his downfall and sparked a broader social movement encouraging victims to speak openly about sexual abuse by powerful men.
The case concerned allegations that Weinstein raped Jessica Mann in a hotel room in 2013, despite her resistance and repeated refusals. The producer pleaded not guilty and has denied ever assaulting women or engaging in non-consensual sexual acts. His lawyers argued that Mann fabricated the rape accusation because her romantic relationship with their client did not help advance her career.
At his first New York trial in 2020, Weinstein was convicted of raping Mann and assaulting former production assistant Miriam Haley in 2006. However, the state’s highest court overturned his 23-year prison sentence, ruling that he had not received a “fair trial.”
In June 2025, jurors in another Manhattan court found him guilty of sexually assaulting Haley and not guilty regarding allegations involving former model Kaja Sokola. In that trial as well, jurors failed to reach a unanimous decision on the charge related to Mann’s rape allegations. Judge Curtis Farber declared a mistrial and ordered a retrial, which began in April.
Weinstein was also convicted of rape charges in California in 2022 and is currently serving a 16-year prison sentence there. For the assault on Haley, the Miramax co-founder faces up to 25 years in prison.
Manhattan District Attorney Alvin Bragg said he was “disappointed” by the declaration of a mistrial while the victim has been “fighting for justice” for nearly a decade.
