Greek Supreme Court rules reduced alimony for husband in landmark decision due to wife’s extramarital affairs

He will pay 100 euros instead of 1,500

In a landmark decision, the Supreme Court of Greece ruled that a husband was entitled to pay a reduced monthly divorce alimony of 100 euros to his now ex-wife, instead of 1,500 euros after it was proven she was engaged in multiple extra-marital relations during their marriage.

The Supreme Court reached its ruling and justified the ex-husband who proved that while his wife was married had multiple extramarital affairs with people from their close social circle.

In June 2016, the husband filed a lawsuit in the Court of First Instance of Thessaloniki requesting the dissolution of his marriage. A month later, the wife also requested the dissolution of their marriage, citing “shocking events in their married life due to the fault of her husband” and at the same time requested that she be awarded a monthly alimony of 1,500 euros.

In April 2017, the lawsuits were litigated together and the husband objected to the award of 1,500 euros per month requesting “payment of reduced (elementary) alimony, of 100 euros per month”, citing in writing that his wife:
“She fell into misdemeanors, which constitute a reason for divorce, as in the past she had intermittent extramarital affairs, a fact that I was informed by a person in our close family circle and in fact a close friend of the wife, almost at the same time as I left our marital home. Apparently, the friend of the defendant, with whom she has not been in contact for the last few years, expected this outcome in our relationship and hurried to inform me about her misdeeds.”
