The Macron couple will present scientific evidence in court to prove that Brigitte is a woman

There will be expert testimony of a "scientific nature" revealed the couple's lawyer in a BBC podcast - The background to the lawsuit they have filed against Candace Owens

Newsroom September 18 10:59

Emmanuel Macron and his wife, Brigitte, plan to present photographic and scientific evidence to a US court to prove that Mrs Macron is a woman, the couple’s lawyer revealed a few hours ago while speaking on a BBC podcast.

Tom Clare said the French president and First Lady will produce the documents as part of a defamation lawsuit they have filed against conservative influencer Canda Owens, who has been publicly promoting her belief that Brigitte Macron was born a man. As the British network recalls, Ms Owens’ lawyers have filed a motion to dismiss the lawsuit.

Speaking on the Fame Under Fire podcast, the couple’s lawyer in the case said Brigitte Macron finds the allegations in question “incredibly disturbing” and that what is being said is “distracting” to the French president. “I’m not suggesting that this case has distracted him. But as would be the case with anyone trying to combine career and family life, when your family is under attack, it affects you. He’s not invulnerable to these situations because he’s the president of a country.”

He said there would be “expert testimony that will be scientific in nature.” Although he declined to reveal further details about it, he said the pair were prepared to prove beyond reasonable doubt that the allegations are false “both generally and specifically.”

“It’s extremely disturbing to think that you have to go through something like this to present evidence of this type It is a process to which she would have to undergo in a very public way, but she is willing to do so. She is determined to do whatever it takes to restore the truth. If the suffering and embarrassment she feels through this report can lead to the truth being restored and an end to this case, she is 100% ready to carry that burden.”

Asked if the Macrons intend to produce photographs of Brigitte when she was pregnant and snapshots of her raising her children, Mr. Clare said that this material exists and will be presented to the court, where there are rules for these kinds of proceedings.

Ms Owens, a former commentator for the conservative US media outlet Daily Wire who has millions of followers on social media, has repeatedly claimed publicly that Brigitte Macron was born a man. In March 2024, she claimed she would “stake her professional reputation” on that belief.

The claims about Brigitte Macron’s gender surfaced in fringe online groups several years earlier, most notably via a YouTube video in 2021 by French bloggers Amandine Roy and Natasha Ray.

The Macrons initially won a libel lawsuit against the two women in 2024, but that decision was overturned on appeal in 2025, on freedom of expression grounds rather than on the basis of the truth of the allegation. The Macrons appealed the decision. In July, the Macrons filed a lawsuit against Ms Owens in the US, complaining that she “ignored all credible evidence that negated her allegation in order to promote known conspiracy theories and sycophants.”

In libel cases against public figures tried in the US, plaintiffs need to prove “actual malice” – that is, that the defendant knowingly spread false information or acted with a disregard for the truth.

Last August, Emanuel Macron explained to French magazine Paris Match why he and his wife chose to go the legal route, stressing that they felt they had to defend their honour against the nonsense being bandied about. “This is a woman who knew full well that she had false information and did so with the intention of causing harm, serving an ideology,” he said of Owens.

Ms. Owens’ lawyers filed a motion to dismiss the lawsuit, arguing that it should not have been filed in Delaware because, they say, it does not involve her businesses, which are registered with the state. They claim that requiring her to defend herself in Delaware would cause “significant financial and practical hardship” to the influencer.
