Gang rape of a drugged 13-year-old who died at the end of the ordeal. For the Austrian judiciary, there is no reason for a murder charge against the Afghan quartet (16, 18, 22, 23). Only the sexual harassment of the student from Tulln is dealt with. As far as one can believe the media coverage, which is largely consistent from the newspapers Standard to Heute, no negligent homicide or failure to render assistance is being dealt with.
The 13-year-old partied with four Afghan men, also known as “refugees,” on June 25. The next day she was found dead – she was leaning against a tree on a green strip in the city of Vienna.
The spokeswoman for the public prosecutor’s office, Nina Bussek, announced to the public that the three suspects had to answer on suspicion of rape and serious sexual abuse. Not a word of murder, manslaughter or failure to provide assistance. Not a word about substance abuse. The question that arises for the legal layperson is: why?

During the “party” the Afghans drugged the young schoolgirl, she received an overdose of ecstasy, and other drugs may have been involved. At least two of those present sexually assaulted their defenseless victim. When the girl passed out, they tried to feed him milk and yogurt. In vain, she died. The corpse was wrapped in a carpet and taken to the location mentioned above. Instead of calling an ambulance in time, they accepted her death and discarded her like rubbish.
The trial is awaited with anticipation. It is to be expected that the defense will argue that these are poor, traumatized refugees who would by now be well integrated in Austria and whose lives should not be upset by a harsh judgement. The fact that the 13-year-old Austrian girl Leonie died because of their actions is hardly more than a footnote. For “only” the rape of a minor is being tried.
